These Terms and Conditions ("Terms") govern your access to and use of the
website located at www.alulaskyaviation.com (the "Site"), all content and
communications distributed by Alula Sky ("Alula Sky," "we," "us," or "our"),
and all products and services we offer now or in the future, whether free
or paid — including but not limited to:
• the Site itself and all pages, articles, and content on it;
• email communications we send you, including the free 30-Day Checkride
Countdown email sequence and any other newsletters or announcements;
• free downloadable materials, including checklists, cheat sheets, and PDFs;
• free articles and educational content published on the Site;
• social media content we post under the Alula Sky name or handle
(including @alulaskyaviation and any other current or future accounts);
• CLEARED — The Private Pilot Checkride Workbook, in physical and/or
digital (PDF) form, including bulk/school orders; and
• any other product, tool, guide, workbook, course, or service Alula Sky
makes available in the future, whether offered for free or for a fee
(collectively, the "Materials").
By accessing the Site, subscribing to our emails, downloading any free
Materials, or purchasing any product from Alula Sky, you agree to these
Terms. If you do not agree, please do not use the Site or our Materials.
1. WHO WE ARE
Alula Sky is a private pilot checkride preparation company, founded in and
operating from the State of South Dakota. We are not the Federal Aviation
Administration (FAA), a Designated Pilot Examiner (DPE), a flight school,
or a certificated flight instructor (CFI), and we are not affiliated with,
endorsed by, or acting on behalf of any of them.
2. EDUCATIONAL PURPOSE ONLY — NOT A REGULATORY OR OFFICIAL REFERENCE
All Materials provided by Alula Sky — including the Site, our emails, free
downloads, free articles, social media content, and CLEARED — are provided
for educational and test-preparation purposes only. They are study aids,
not legal, regulatory, or operational references, and not a substitute for:
• instruction from an authorized Certificated Flight Instructor (CFI);
• the current Federal Aviation Regulations (14 CFR);
• the Aeronautical Information Manual (AIM);
• the applicable Airman Certification Standards (ACS);
• your aircraft's Pilot's Operating Handbook / Approved Flight Manual
(POH/AFM); or
• the judgment of your CFI or your Designated Pilot Examiner.
Aviation regulations, procedures, and standards change over time. Alula Sky
makes reasonable efforts to keep its content accurate and current, but we
do not guarantee that any Material — including CLEARED, our free checklists
and cheat sheets, our articles, our emails, or our social media content —
reflects the most current version of any regulation, standard, limit, or
procedure at the time you use it.
Where anything in our Materials conflicts with the current FARs, the AIM,
your POH/AFM, your CFI, or an examiner, those official sources govern —
not our Materials. You are responsible for independently verifying any
regulatory figure, limit, or procedure against current official sources
before relying on it for any test, checkride, or flight.
This Section applies to CLEARED specifically, in addition to the terms in
Section 5 below.
3. NO GUARANTEE OF OUTCOME
Alula Sky does not guarantee that use of any Material — free or paid —
will result in passing any FAA knowledge test, practical test (checkride),
or any other exam or certification. Outcomes depend on your own study,
flight training, aptitude, and readiness, none of which are within our
control.
4. FREE MATERIALS (EMAILS, 30-DAY COUNTDOWN, DOWNLOADS, ARTICLES, SOCIAL MEDIA)
4.1 General. Free Materials — including the 30-Day Checkride Countdown
email sequence, any other email newsletter, free checklists and cheat
sheets, free articles on the Site, and social media posts — are provided
"as is," for general informational and study purposes, with no warranty
of accuracy, completeness, or currency, and no guarantee of any particular
study outcome.
4.2 The 30-Day Checkride Countdown. When you sign up for the 30-Day
Checkride Countdown, you consent to receive one email per day for
approximately 30 days containing study guidance and practice questions,
followed by occasional additional emails from Alula Sky (such as product
updates or other free content). You may unsubscribe at any time using the
link in any email or by contacting us at info@alulaskyaviation.com. We will
process unsubscribe requests within a reasonable time as required by law.
4.3 Other emails. By providing your email address to Alula Sky — whether
through the 30-Day Countdown, a download form, or a purchase — you consent
to receive marketing and informational emails from us. You may opt out at
any time; opting out of marketing emails will not affect transactional
emails related to a purchase you've made (such as order confirmations).
4.4 Social media. Content Alula Sky posts on Instagram or any other
platform is provided for general educational and engagement purposes, is
subject to this Section, and is not a substitute for the official sources
listed in Section 2. Third-party platforms (e.g., Instagram/Meta) have
their own terms and privacy practices, which are outside our control.
5. CLEARED — THE PRIVATE PILOT CHECKRIDE WORKBOOK (AND OTHER PAID PRODUCTS)
5.1 Nature of the product. CLEARED is an independent study aid for FAA
Private Pilot ASEL applicants. It does not replace your CFI, official FAA
publications, or the ACS. See Section 2 for the full disclaimer, which
applies fully to CLEARED and to any other paid Material Alula Sky offers
now or in the future.
5.2 License to use. When you purchase CLEARED (or any other paid Material),
Alula Sky grants you a personal, non-exclusive, non-transferable license to
use it for your own study or, for school/bulk orders, for the students
covered by that order. You may not copy, reproduce, scan, redistribute,
resell, post, or share CLEARED or any other paid or free Material — in
whole or in part, digital or physical — without our prior written
permission. All content is protected by copyright and remains the property
of Alula Sky.
5.3 School / bulk orders. Bulk or per-student orders for flight schools are
licensed for use by the students and instructors covered under that specific
order, as agreed at time of purchase, and are subject to the same
copy/redistribution restrictions in Section 5.2. Any instructor guide
provided with a bulk order is for use by that school's instructors only.
5.4 Digital delivery. Digital (PDF) purchases are delivered electronically
via download link or email shortly after your purchase is confirmed. If you
purchase the printed workbook, the digital fillable PDF is included free
and made available to you immediately so you can begin working in it while
your printed copy is in production and transit.
5.5 Pricing and payment. Prices are listed on the Site and are subject to
change without notice for future purchases. Payments are processed
securely through our website's checkout provider (Wix Payments and any
other payment method made available at checkout).
5.6 Refunds and returns. All sales are final. Alula Sky does not offer
refunds or returns on any product, physical or digital, including CLEARED,
school/bulk orders, and any other paid Material, except where required by
law. Please review product details carefully before purchasing.
5.7 Shipping. Printed workbooks are printed to order and typically ship
within 3–5 business days. [INSERT: shipping regions/countries served, and

6. FUTURE PRODUCTS
Alula Sky intends to offer additional products over time — including, but
not limited to, materials for the Instrument and Commercial ratings — in
free and paid formats, in physical, digital, or online form. These Terms
automatically apply to any such future Material unless we post separate
terms specific to that product, in which case those separate terms
control for that product to the extent they conflict with these Terms.
7. INTELLECTUAL PROPERTY
All content on the Site and in our Materials — including text, graphics,
diagrams, layout, the CLEARED workbook, our checklists and cheat sheets,
our articles, and the Alula Sky and CLEARED names and logos — is owned by
Alula Sky or its licensors and is protected by copyright, trademark, and
other intellectual property laws. Except for the limited personal-use
license in Section 5.2, no Material may be copied, modified, distributed,
publicly displayed, or used to create derivative works without our prior
written permission.
7.1 Attribution — learning science methods. Where our Materials refer to
the "six learning methods," the "six human being learning methods," or
similar language describing our study framework, we are referring to the
"Six Strategies for Effective Learning" — Spaced Practice, Retrieval
Practice, Elaboration, Interleaving, Concrete Examples, and Dual Coding.
This framework originated on The Learning Scientists blog (2016), created
by Dr. Yana Weinstein and Dr. Megan Sumeracki (then Megan Smith) and
illustrated by Oliver Caviglioli, building on Dunlosky et al.'s 2013 review
of learning techniques in Psychological Science in the Public Interest,
and overlapping with Dr. Pooja Agarwal's retrieval-practice research and
the book Make It Stick (Brown, Roediger, and McDaniel, 2014). This is
third-party research Alula Sky did not originate and does not claim
ownership of; we apply it as an instructional framework within our
Materials, and credit it here accordingly.
8. ACCEPTABLE USE
You agree not to: use the Site or our Materials for any unlawful purpose;
attempt to copy, scrape, or redistribute our content beyond the license
granted in Section 5.2; impersonate Alula Sky or claim official FAA/DPE
affiliation; or interfere with the operation or security of the Site.
9. NO WARRANTY
THE SITE AND ALL MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT
WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT
LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR
ANY MATERIAL WILL BE ERROR-FREE, UNINTERRUPTED, OR REFLECT THE MOST CURRENT
REGULATORY INFORMATION AVAILABLE AT THE TIME OF USE.
10. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, ALULA SKY AND ITS FOUNDER(S),
EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT,
INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF
DATA, INCOME, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE
SITE OR ANY MATERIAL — INCLUDING ANY ERROR, OMISSION, OR OUTDATED
INFORMATION IN ANY FREE OR PAID MATERIAL — EVEN IF WE HAVE BEEN ADVISED OF
THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, OUR TOTAL LIABILITY TO YOU
FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE OR MATERIALS WILL NOT
EXCEED THE AMOUNT YOU PAID TO ALULA SKY, IF ANY, IN THE 12 MONTHS BEFORE
THE CLAIM AROSE.
Some jurisdictions do not allow certain limitations of liability, so some
of the above limitations may not apply to you.
11. YOUR RESPONSIBILITY
By using the Site or any Material, you acknowledge and agree that:
• you are solely responsible for your own flight training decisions,
checkride readiness, and compliance with current FAA regulations;
• you will independently verify any regulatory content against current
official sources and your CFI's guidance, as described in Section 2;
• Alula Sky is not responsible for errors or omissions in any Material,
or for any decision you make based on its content.
12. PRIVACY / DATA COLLECTION
This Site is built and hosted on Wix. Information you submit through the
Site — including through the 30-Day Checkride Countdown signup, a free
download form, or a purchase — is collected and processed using Wix's
platform and tools (including payment processing for purchases). For
details on what information is collected, how it is used and stored, and
your rights regarding that information, please refer to Wix's own privacy
policy at www.wix.com/about/privacy. Alula Sky does not independently
store or sell your personal information outside of what is collected and
processed through the Wix platform.
13. CHANGES TO THESE TERMS
We may update these Terms from time to time. The "Last Updated" date above
reflects the most recent changes. Continued use of the Site or our
Materials after changes are posted constitutes acceptance of the updated
Terms.
14. GOVERNING LAW
These Terms are governed by the laws of the State of South Dakota, without
regard to its conflict-of-law principles, and any dispute arising from
these Terms or your use of the Site or Materials will be resolved in the
state or federal courts located in South Dakota.
